What Courses do I have to complete to File Bankruptcy in North Carolina?

There are two courses that a person filing for Chapter 7  Bankruptcy in North Carolina is required to take.

Pre-Filing Credit Counseling Course:
A North Carolina debtor must take a Credit Counseling Course from an approved credit counseling company with 180 days before the bankruptcy petition is filed.  It is a best practice to submit your certificate of completion with your bankruptcy petition, while in some circumstances you can submit your certificate within 14 days after your petition is filed.The credit counseling course generally consists of an evaluation of your personal financial situation, a discussion of alternatives to bankruptcy, and a personal budget plan.  Many approved counseling companies allow the course to be conducted in person, on the telephone, or even on the Internet.  Please click on this link for a list of approved credit counseling companies located near you provided by the United States Bankruptcy Court for the Middle District of North Carolina.

Post-Filing Debtor Education Course:
After you file your bankruptcy petition but before the date of your discharge, you must complete a debtor education course.  Once the course is complete, the debtor will receive a certificate of completion and the certificate must be filed with the Bankruptcy Court before the scheduled discharge date.  If the certificate of completion for the debtor educatoin course is not filed prior to the discharge date, the Bankruptcy Court will close your case without discharging the debtor’s debts.   Please click on the following link for a list of approved debtor education courses located near you provided by the United States Bankruptcy Court for the Middle District of North Carolina.
